Article 7 - Data collection and protection

Your personal data is collected by Across and Beyond Endurance AG.
Personal data means any information relating to an identified or identifiable natural person (data subject); an identifiable person is one who can be identified, directly or indirectly, in particular by reference to a name, an identification number or one or more factors specific to his or her physical, physiological, genetic, mental, economic, cultural or social identity.
Any personal information collected on the site is mainly used by the editor to manage relations with you and, where applicable, to process your orders.

The personal data collected is as follows:
- surname and first name
- address
- e-mail address
- telephone number
- date of birth
- and any other data relating to the creation of a participant account (postal address, nationality, etc.)
- financial data: as part of the payment for products and services offered on the Platform, the latter records financial data relating to the user's credit card.


The GPS beacon given to the participant continuously records his or her positions throughout the event. ABE may use this data in any way it sees fit.

In the event of abandonment, it is the responsibility of the participant to immediately inform the Operational Management Station, in order to suspend the recording and public distribution of his GPS data.

The participant acknowledges, consents and expressly authorizes the collection and dissemination of his or her GPS positions via this system as part of the event.

Any third party wishing to access this data for personal purposes, where it concerns their own information collected during the event, must make a prior request to the Organizer.

ABE implements all appropriate technical and organizational measures to guarantee the security, confidentiality and integrity of the personal data collected, and to prevent any unauthorized access, loss or disclosure.

Transfers outside the European Union:
Certain data may be transferred and processed outside the European Union (notably to Switzerland and Canada). Such transfers are subject to appropriate safeguards, such as the European Commission's standard contractual clauses.

Article 8 - Right of access, rectification and deletion of your data

Pursuant to the regulations applicable to personal data, users have the following rights:

• right of access: users may exercise their right of access to their personal data by writing to the e-mail address given below. In this case, before exercising this right, the Platform may request proof of the user's identity in order to verify its accuracy;

• the right of rectification: if the personal data held by the Platform are inaccurate, they may request that the information be updated;

• the right of deletion of data: users may request the deletion of their personal data, in accordance with applicable data protection laws;

• the right to restrict processing: users may request the Platform to restrict the processing of personal data in accordance with the assumptions set out in the RGPD ;

• the right to object to data processing: users may object to their data being processed in accordance with the assumptions set out in the RGPD ;

• the right to portability: customers can request that the Platform return the personal data they have provided, so that it can be transferred to a new Platform.

As part of the sporting events organized by ABE, participants may be filmed and/or photographed.

By validating their registration, they acknowledge and expressly authorize the free use of their image and voice for communication, promotion and dissemination purposes by ABE and its partners (website, social networks, press, promotional materials), without limitation of time or territory, unless expressly objected to by the organizer prior to the event.

Article 15 - Applicable law

The present conditions of use of the site are governed by Swiss law and are subject to the jurisdiction of the courts of the publisher's registered office, subject to any specific attribution of jurisdiction arising from a particular legal or regulatory text.

Article 16 - General terms and conditions of sale (GTCS)
